DeKalb County Marriage Certificate Rules

Alabama no longer uses the former marriage-license application process. The DeKalb County Probate marriage page explains that Alabama changed the process under Act 2019-340 beginning August 29, 2019. Probate courts do not issue a marriage license. The Alabama Marriage Certificate form is the legal document. When it is filled out, signed, notarized, delivered, and recorded, the marriage is valid. A ceremony may still take place, but the ceremony is not required for legal recognition.

DeKalb County adds a few local recording rules that matter before a couple arrives at the Probate Office. The marriage certificate form must be typewritten. Handwritten forms are not accepted because the office needs the document to be clear enough for recording. The original notarized form must be delivered to the Probate Office within 30 days of the latter spouse signature date. Forms are not accepted by mail, and the Probate Office does not provide notary service for marriage forms.

Apply for DeKalb County Marriage Records

A couple preparing a DeKalb County marriage certificate should use the state form, complete it before visiting, and treat the Probate Office as the recording office. The effective date of the marriage is the latter signature date of the spouses, not the date of a ceremony. Recording hours are Monday through Friday, 8:00 a.m. to 4:00 p.m., and the research states no appointment is necessary.

1. Complete the standardized Alabama Marriage Certificate Form supplied through the Alabama Department of Public Health.
2. Type the form. DeKalb Probate will not accept a handwritten form for recording.
3. Sign before a notary who is authorized under Alabama law. A notary from another state is not permitted.
4. Deliver the original notarized form to the DeKalb Probate Office with the filing fee within 30 days of the later spouse signature.
5. Request a certified copy from the Probate Office when proof of the recorded marriage is needed.

Note: DeKalb Probate no longer performs marriage ceremonies and has not done so since February 9, 2015.

DeKalb County Marriage Form Fields

The research does not reproduce every blank on the state marriage certificate, but it does identify the practical field rules that control recording in DeKalb County. The form must be the standardized Alabama Marriage Certificate Form, it must be typewritten, it must be notarized, and it must be delivered as the original document. The Probate Office records the certificate and can later issue a certified copy.

DeKalb County Marriage and Divorce Fees

Marriage and divorce costs depend on the record source. Probate recording fees apply to the marriage certificate and Probate Office certified copies. ADPH certificate fees apply when the requester wants a statewide marriage or divorce certificate. The Circuit Civil chart supplies the local filing fee for a new divorce case, while the Circuit Clerk records-request form controls court-record search and copy charges for DeKalb Circuit and District Court records.

Search DeKalb County Marriage Records

Marriage record access has four documented channels. The DeKalb Probate Office records and certifies the county marriage certificate. The Rainsville Annex is also listed as a Probate Office location. ADPH issues statewide marriage certificates from August 1936 forward and states that marriage certificates are unrestricted, so anyone may request one if enough search information and payment are supplied. The DeKalb Probate Records Application includes an "Include Marriage Index" checkbox in its search template, which means marriage index material may be included where the app is configured for it.

Find DeKalb County Divorce Records

Divorce files are not Probate Office marriage records. DeKalb divorce cases are Circuit Court and Domestic Relations records. The Domestic Relations page names Melinda Whitten as Domestic Relations Clerk and gives the main Circuit Clerk phone with option 3 for domestic and circuit civil matters. The local page also warns that divorce filings can be complex, especially when children are involved, and that the clerk cannot give legal advice or supply fill-in-the-blank pleadings for many filings.

For a full divorce case file or decree, use the DeKalb Circuit Clerk, Alacourt, or the official request form. ADPH handles divorce certificates from 1950 forward and says divorce certificates are unrestricted. Required search data includes the full names before first marriage of both spouses, the date of divorce, the county where it was granted, requester name and signature, mailing address, and daytime phone. Pre-1950 divorce information must be obtained from the circuit court in the county that granted the divorce.

Certified DeKalb County Divorce Copies

A certified copy is the copy with official attestation. It may be needed for benefits, name changes, remarriage proof, court filings, or corrections. Marriage certificate copies come from the Probate Office or ADPH, depending on which certificate is needed. Divorce certificates come from ADPH for records from 1950 forward, but the underlying decree and case file stay with the Circuit Court that granted the divorce.

Corrections follow the record source. ADPH says divorce certificate errors must be corrected through the Alabama county circuit court that granted the divorce. In DeKalb County, that means the Circuit Court and Domestic Relations division for local divorce cases. If the question is a recorded marriage certificate, the Probate Office is the starting point for county recording and certified-copy issues.

The Circuit Clerk records-request form is the fallback for court copies when the divorce file or decree is needed from DeKalb Circuit Court. It asks for case numbers when known, identifying information, certification choice, requester name, mailing address, phone number, and the specific records requested. The form states that personal checks are not accepted, that a self-addressed stamped envelope should be included, and that the clerk's office handles only DeKalb County Circuit and District Court records.

Alabama Vital Records Certificates

The statewide certificate route is useful when the need is a certified vital-record certificate rather than a full court file. ADPH handles marriage certificates from August 1936 forward and divorce certificates from 1950 forward. Its marriage and divorce certificate pages state that these records are unrestricted, subject to the requester providing enough information for the search and paying the required fee. ADPH also offers an expedite fee, but that does not change where DeKalb divorce case files are held.
